Terms & Conditions

1. Introduction
These Terms and Conditions govern your use of the Pacheca Wine Club website and your participation in the Pacheca Wine Club Semi-Annual Membership. By visiting the Site, purchasing products, or subscribing to the Wine Club, you agree to be legally bound by these Terms.

These Terms apply to customers residing in the United States where DTC wine shipment is allowed.

2. Eligibility
You must be 21+, provide a valid U.S. shipping address, and ensure an adult signature upon delivery. Shipments not permitted to PO Boxes or to UT, MS, DE, AL. AK and HI may face restrictions.

3. Membership Overview
Semi-annual shipments of 12 bottles: 6 exclusive Pacheca wines, 6 Pacheca Group wines. Curated selection only.

4. Membership Billing
Shipment cost: $499 USD. Taxes via Avalara AvaTax. Charged immediately upon joining. Billing occurs in May and late October.

5. Renewal & Cancellation Policy
Membership renews automatically. Cancellation allowed anytime; processed charges are non-refundable. Benefits end immediately upon cancellation.

6. Membership Changes
Address changes allowed until 15 days before shipment. Payment changes until charge date. Skip allowed once; pause up to 6 months.

7. Shipping & Delivery
Fulfilled by WineCub (Texas) via FedEx. Signature required. Warehouse errors reshipped free; customer errors billed. Lost shipments replaced after FedEx confirmation.

8. Damaged or Defective Wines
Broken bottles replaced immediately. Corked/defective wines replaced within 30 days. Lost shipments reshipped. Claims: 7 days for transport issues; 30 days for defects.

9. Member Benefits
Active members receive 15–20% discount on U.S. website wine purchases, discounted shipping, educational content, and invitations to exclusive events.

10. Customer Accounts
Members must maintain accurate information and secure login credentials. Access via /apps/awtomic/customer-portal.

11. Prohibition on Resale
Resale prohibited without written authorization.

12. Intellectual Property
All site content is property of the PACHECA Group. UGC requires explicit authorization.

13. Privacy & Data Use
Compliant with CCPA/TCPA. Marketing email/SMS opt-in required. Data shared with Shopify, Awtomic, WineCub, Avalara for operational purposes. Full Privacy Policy applies.

14. Limitation of Liability
PACHECA WINE CLUB USA LLC is not liable for delays due to weather, carriers, regulatory holds, or force majeure. Liability limited to purchase amount.

15. Governing Law & Arbitration
These Terms are governed by Texas Law. Disputes resolved by binding arbitration in Texas.

16. Amendments
Terms may be updated periodically. Continued membership implies acceptance.
